Proposed Part 101 of CASR miscellaneous amendments 2026 - (CD 2613US)

Overview

We are seeking feedback on 3 proposals affecting drone and rocket operations, remote pilots, and training providers.

The proposals would amend

• Part 101 of the Civil Aviation Safety Regulations 1998 (CASR)
• The Civil Aviation (Fees) Regulations 1995
• The Civil Aviation Regulations 1988.

The proposals would:

• require Notices to Airmen (NOTAMs) for approved drone and rocket operations, only when the NOTAMs provide an aviation safety benefit
• align an existing regulation with current record-keeping requirements, without changing operators’ existing requirements
• allow CASA to set and manage nationally consistent RePL and BVLOS examinations, delivered by CASA-approved providers.

The proposals aim to improve efficiency, clarity and consistency while maintaining aviation safety.

This consultation may be relevant to you if you:

• conduct drone or rocket operations requiring CASA approval for a specific area
• operate uncrewed aircraft covered by existing record-keeping requirements
• hold or are applying for a remote pilot licence (RePL)
• conduct beyond visual line-of-sight (BVLOS) operations
• provide RePL training.

Previous consultations

Before this consultation, CASA consulted publicly on the post-implementation review of Part 101 of the CASR and its MOS. Consultation PP 2107US included proposed policy initiatives that are now reflected in this legislative amendment package.

A technical working group (TWG), established through the Aviation Safety Advisory Panel, has also considered proposed amendments to the Part 101 regulatory framework. The TWG includes representation from across industry.

What happens next

At the end of the response period, we will:

• Review all feedback
• Make responses publicly available on the consultation hub (unless you request your submission remain confidential)
• Publish a Summary of Consultation which summarises the feedback received and outlines any intended changes and next steps.

All feedback on the proposed legislation amendments will be considered. Relevant feedback that improves upon the proposed instrument may be incorporated into the final instrument.

Post-implementation review

CASA will monitor and review the new rules during the transition phase and on an ongoing basis. We will also continue working on further proposed changes to the Part 101 regulations to better support remotely piloted operations.
